Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of Tsunami Automation's Services and is incorporated into our Terms of Service. It reflects the requirements that our telephony and messaging provider, our payment provider, and applicable laws such as the TCPA flow down to you. You are responsible for your use of the Services and for anyone acting through your account. Violation of this AUP is a material breach and may result in suspension or termination.
1. Prohibited Conduct
You must not, and must not allow anyone to:
- Illegal use. Use the Services in violation of any law, regulation, telecommunications rule, or carrier standard, or to facilitate anything illegal.
- Communications without required consent. Send calls or messages without all legally required consent. For marketing, prior express written consent is required; for other regulated messages, prior express consent is required. Consent may not be bought, sold, rented, shared, or transferred between brands.
- Ignoring opt-outs / spam / TCPA-violating campaigns. Fail to honor opt-out requests (such as STOP), send unsolicited bulk or spam messages, or run any campaign that violates the TCPA, CAN-SPAM, or carrier or CTIA messaging rules.
- Harmful or prohibited content. Transmit content that is harassing, threatening, fraudulent, deceptive, defamatory, obscene, or exploitative, or that relates to SHAFT categories (sex, hate, alcohol, firearms, tobacco) where prohibited by carrier rules.
- Malware and harmful code. Introduce viruses, malware, or other harmful code, or deploy unauthorized bots, scripts, or automated agents against the Services.
- Security violations. Attempt to gain unauthorized access to the Services, other accounts, or connected systems; conduct denial-of-service attacks; probe or exploit vulnerabilities; or bypass usage or rate limits or other technical controls.
- Spoofing and origin falsification. Falsify, mask, or misrepresent your identity, phone number, sender ID, or the origin of any call or message.
- Reverse engineering. Reverse engineer, decompile, or attempt to extract source code or models, except to the extent this restriction is prohibited by law.
- Unpermitted data use or scraping. Scrape, harvest, or process data you are not permitted to use, or submit data to the Services without the rights and consents needed to do so.
- Restricted business categories. Use the Services or the payment path for any business, product, or activity that our payment processor or payment-network rules classify as restricted or prohibited.
- Resource and rate abuse. Overburden or interfere with the Services' infrastructure, exceed fair-use or rate limits, or use the Services in a way that degrades performance for others.
2. Your Responsibility for End Callers
Because the Services answer, record, and transcribe inbound calls and send SMS on your behalf, you are responsible for obtaining all required consents from your callers and message recipients, including all-party call-recording consent where required and TCPA consent for texts, and for not disabling the recording notice, AI-assistant disclosure, or consent prompt. These obligations are set out in Section 14 of the Terms of Service and described in our Call Recording & Consent Notice and SMS Terms.
3. Enforcement & Consequences
If we believe you have violated this AUP, or if a provider, carrier, court, or authority requires it, we may, with or without notice where lawful:
- Suspend or limit some or all of the Services;
- Remove or disable offending content or campaigns;
- Terminate your account under the Terms of Service; and
- Report the activity to carriers, payment providers, or law-enforcement or regulatory authorities as required or appropriate.
We will use reasonable efforts to give notice and an opportunity to cure where practicable, but we may act immediately to address legal, security, or carrier-compliance risk. You remain responsible for any liability arising from your violation, including under the indemnity in Section 23 of the Terms of Service.
